Partnership agreement
Version 2026-11-04
Shop partnership agreement
Article 1 — Purpose
This agreement is between TCHAHIT and the registered shop (restaurant, café, pastry shop, grocery). TCHAHIT lets the shop present its menu, receive and track orders, work with couriers, and use the QR Menu and management tools included in its plan.
Article 2 — Who does what
The shop is an independent merchant selling in its own name and for its own account. TCHAHIT is a technical intermediary: it does not cook, sell or own the goods. The courier is independent and performs the delivery.
Article 3 — Registration and acceptance
The shop provides accurate, valid documents (commercial register or craft card) and updates them whenever they change. It accepts the Terms of use, this agreement and the Privacy policy with one checkbox at signup; the date and the accepted version are kept.
Article 4 — Menu and prices
The shop alone sets the price of each dish. It keeps an accurate, up-to-date menu (prices, ingredients, allergens, availability) and immediately switches off any unavailable item.
Article 5 — Quality and safety
The shop alone is responsible for preparation, hygiene, food quality and safety, and for compliance with the law.
Article 6 — Accepting orders
The shop confirms only orders it can prepare. It may refuse an order for unavailability, location mismatch or suspected abuse. It prepares a confirmed order within the announced time. If orders repeatedly go unanswered, new orders may be paused for a while until the shop resumes them.
Article 7 — Packaging and handover to the courier
The shop hands the order over complete, closed and packed for transport, and only to the courier assigned in the app. The shop remains responsible for the content until that handover.
Article 8 — Delivery fee
The fee starts from the shop or zone base rate, plus a per-kilometre price for the road distance, and is shown to the customer before confirmation. The shop alone decides to offer free delivery; it then pays the fee itself and the courier receives his full pay. If the shop delivers with its own staff, it follows the same handover rules: the delivery code, and only the amount shown.
Article 9 — Cash on delivery
At pickup, the courier pays the shop the order amount shown in the app; this payment is recorded, and the courier then collects the full amount from the customer. The shop never asks for an amount other than the one shown. If online payment is activated, the settlement rules will be sent to the shop before they apply.
Article 10 — Refusal at the door
If the customer refuses a correct order, the courier brings the food back to the shop. The shop then pays him back the advance paid at pickup plus the delivery fee (current platform setting). The shop records this payment in the app; the courier confirms or disputes it, and the matter closes after 48 hours without a dispute. The shop decides what to do with the returned food.
Article 11 — Complaints and errors
The shop answers support tickets about its orders honestly and without delay. It bears the cost of errors due to it (missing item, wrong item, poor packaging, wrong information), as decided by support after reviewing the evidence; it may contest with evidence.
Article 12 — Subscription and commission
The subscription is currently 6,700 DZD per month, and can be prepaid for 3, 6 or 12 months at a discount. The price in force is published on the pricing page and shown under “My subscription”. Commission on orders and errands is 0% at launch; any change to the price or the commission is announced in advance and is never retroactive. The administration may grant a trial, with its length confirmed in writing.
Article 13 — Late payment
Once the announced payment grace period ends, the shop’s listing and order intake stop until payment is made. The shop’s data is never deleted for non-payment.
Article 14 — Customer data and conduct
The shop uses customer data (name, phone, address) only to fulfil the order: it does not copy it, sell it or use it for advertising. Data is processed under the Privacy policy and Law 18-07. The shop treats customers and couriers with respect; fake orders and fake reviews are forbidden.
Article 15 — Suspension and termination
TCHAHIT may suspend the account for a serious breach, repeated complaints, false documents or fraud, and tells the shop the reason. The shop may contest through support with evidence. The shop may end its subscription at any time once pending orders and amounts are settled.
Article 16 — Liability, changes and governing law
Each party answers for its own acts, and this agreement excludes no liability that the law does not allow to be excluded. Any change to the agreement is announced in advance and applies only afterwards. A dispute is first settled amicably through support, then under Algerian law before the courts set out in the Terms of use.
Independent courier agreement
Article 1 — Purpose and status
This agreement is between TCHAHIT and the registered courier. The courier uses the platform to receive and carry out order deliveries and errands as an independent service provider. It creates no employment, subordination or agency relationship between him and TCHAHIT.
Article 2 — Freedom of activity
The courier chooses when to go online and offline, with no imposed hours, and he accepts or declines offers freely. He may set his work radius, his minimum fee and his cash-advance limit where the app allows it, and he may work for others. TCHAHIT guarantees no number of jobs and no income.
Article 3 — Means and legal obligations
The courier works with his own means of transport and at his own cost: motorbike, car, bicycle or on foot. He holds the documents and insurance the law requires for his vehicle and activity, and he handles his own tax and social obligations.
Article 4 — Identity verification
The courier takes, in the app, a photo of his ID card and a selfie, declares his vehicle type and keeps his details up to date. Refused pictures are deleted after a set delay (30 days by default); other data is kept as described in the Privacy policy.
Article 5 — Location
While online, the courier shares his real location without falsifying it. It is used only to offer nearby jobs, calculate distance, track the handover and provide support.
Article 6 — Accepting a job
Before accepting, the courier checks the pickup point, the destination, the amount and his pay. Accepting commits him to complete the job; if he cannot, he tells the app or support at once so it can be reassigned.
Article 7 — Pickup at the shop
The courier takes the order closed, as the shop handed it over, and does not open it. Before leaving, he reports any package that is open or damaged. For a cash order, he pays the shop the amount shown in the app, recorded as an advance.
Article 8 — Transport and safety
The courier uses a closed, clean delivery bag, and respects food hygiene and traffic law. For his safety, the app may pause new offers for a while after a long stretch of continuous work.
Article 9 — Handover and delivery code
The courier hands the order to the customer who gives him the correct delivery code after receiving and checking it. He never asks for the code before handover and never records a delivery without it; if the code fails, he contacts support.
Article 10 — Amounts
The courier collects only the amount shown in the app, never asks for anything extra, and records everything he receives.
Article 11 — Errands
The courier buys the requested items with his own money, within the customer’s estimated budget, going over it by at most 20%. He keeps the receipt and attaches a photo of it in the app, then hands over the goods and collects the receipt amount plus the service fee shown.
Article 12 — Pay and subscription
The courier receives the delivery or service fee shown before he accepts the job, and does not negotiate it with the customer. If the shop offers free delivery, the shop pays his full pay; commission is 0% at launch. The subscription is currently 3,000 DZD per month, and can be prepaid for 3, 6 or 12 months at a discount. The price in force is published on the pricing page and shown under “My subscription”; any change is announced in advance and is never retroactive, and the administration may grant a trial.
Article 13 — Late subscription payment
Once the announced payment grace period ends, no new jobs are offered until payment is made. The courier’s data is never deleted for non-payment.
Article 14 — Refusal by the customer at the door
The courier records the refusal in the app while at the address, with the reason, after calling the customer, or after at least two attempts if there is no answer. For a food order, he brings the food back to the shop, which pays him back the advance plus the delivery fee; the courier confirms receipt or disputes it, and the matter closes after 48 hours without a dispute. For a refused errand, he keeps the goods and the receipt until support decides, and he never disposes of an order on his own.
Article 15 — Cash settlement
Every amount the courier holds is recorded in the app (cash custody ledger). He settles it with the shop or the platform as recorded, using the approved handover codes. Above the allowed limit, new cash jobs pause until settlement.
Article 16 — Customer data
The courier uses the customer’s name, phone, address and location only for the job. He does not keep or copy them, and does not contact the customer after the job for any other purpose. Data is processed under the Privacy policy and Law 18-07.
Article 17 — Suspension and termination
The account may be suspended for a serious breach, repeated complaints, false documents, fraud or unsettled cash, and the courier is told the reason. He may contest through support with evidence (receipts, photos, explanation). He may end his subscription at any time after settling the amounts due and completing accepted jobs, or after reporting them to support.
Article 18 — Liability, acceptance and governing law
Each party answers for its own acts; no cost is charged to the courier without a review of the evidence, and he may contest it. This agreement excludes no liability that the law does not allow to be excluded. It is accepted together with the Terms of use and the Privacy policy with one checkbox at signup, and any change is announced in advance. A dispute is first settled amicably through support, then under Algerian law before the courts set out in the Terms of use.
